If you don’t think accurate time records are important, how does that headline grab you? In this case (Vivian Brown v. Family Dollar Stores of Indiana, L.P.) the employee didn’t have accurate records of overtime she should have been paid, but provided evidence of a pattern of underpayments and inaccurate timekeeping records. Employee or Contractor?

Because of a safe harbor provision in the tax code, the IRS forgives many employers that label their employees incorrectly. But when workers sue over labor issues -- discrimination, for example, or wrongful termination -- companies sometimes find that the contractor designation, which they thought would protect them from liability, doesn't hold up in court. And several government agencies besides the IRS, including state tax departments and even state insurance commissions, can dock employers for getting a worker's classification wrong. [more]

The APA is in favor of HR 3359, the Mobile Workforce State Income Tax Fairness and Simplification Act. Currently, most states with an income tax impose some tax on wages earned within their borders by residents of other states. Some have varying de minimis amounts, or thresholds, that need to be exceeded before withholding is required. The thresholds differ widely, including various numbers of days worked within the state and various wage amounts earned. [more]
