Constructive Receipt
Employees’ paychecks are mailed from the corporate office on Tuesday for a Thursday payday. Because of a disaster in the area no mail will be delivered until Saturday, when the employees are not at work. So the employees can get paid during this week, the employer wires cash wages to the employees which they receive on Friday. The checks arrive at the office on Saturday. The checks are shredded and the stubs given to the employees on Monday. When are the wages considered paid?

Six Steps to Crisis Management
Let’s say your organization manually tracks time and attendance for each employee. “Manual” suggests a long paper trail beginning with the employee writing down hours, then the manager reviewing the hours, and then a payroll clerk entering those hours into the payroll system. Not only is this is a green-unfriendly process, but it is also a time consuming and potentially inaccurate process. When tasks and processes are manual, there is a greater chance for error. Overtime suit moves forward
U.S. District Judge Thomas I. Vanaskie denied a request by attorneys representing Lackawanna County asking that the lawsuit filed by 10 Lackawanna County Prison corrections officers be dismissed because they did not address their grievances through their union’s collective-bargaining agreement. The judge ruled Friday that the union’s collective-bargaining agreement doesn’t preclude employees from filing a Fair Labor Standards Act lawsuit. [more]
San Luis Obispo settles police suit over suiting up in protective gear
City agrees to pay officers for the time it takes to get in and out of specialized equipment; annual cost is $24,000. The city of San Luis Obispo has settled a “donning and doffing” lawsuit with its police union for $55,000 in back pay and legal fees, and it will allow officers 10 minutes of paid time during each shift to put on and take off protective gear.
